Homescreen Terms of Service

These terms are an agreement between you and Intentionally Creative LLC for your use of homescreen.agency. Please read them; using Homescreen means you accept them.

The short version

• This website tells you about Homescreen and our products. You can read it, share links to it and contact us.
• Work we do for clients is covered by the written agreement we sign with each client, not by these terms.
• The content is ours. Please don't copy it wholesale or misuse the site.
• If you give us your phone number, we may call and text you about what you asked for, including with AI assistants and AI voices. Marketing calls and texts need your yes, and you can stop any of them at any time. See Calls, texts, AI assistants and recordings.

Using this website

You may browse this website, read and share its pages and use its forms for their intended purpose. You agree not to:

• copy, reproduce or republish substantial parts of the site, its text, designs or images, except as the law allows;
• interfere with the site's security or operation, or try to reach parts of it you are not meant to;
• scrape or harvest the site with automated tools beyond what normal search engines do;
• use the site to send spam, malware or anything unlawful, or to impersonate anyone.

Our content

The site, its text, graphics, logos, designs and code belong to Intentionally Creative LLC or our licensors and are protected by copyright and trademark law. Homescreen and our logos are our trademarks. Using this site does not give you any right in them.

Figures, examples and case studies on the site describe past results for specific clients. They are not a promise of future results.

Our services

Our client work (software, websites, marketing and AI systems) is provided under a separate written agreement signed with each client. Where that agreement and these terms differ, the agreement governs that work. Booking a call or sending a form does not create an agreement for services.

Links and other services

The site links to other sites and services, including our own products. We are not responsible for sites we do not run, and their own terms apply there.

Calls, texts, AI assistants and recordings

This section applies whenever you give us a phone number or an email address: in a form, a chat, a booking, a call or an agreement.

• About what you asked for. You agree that Homescreen, and the companies that place calls and send messages for us, may contact you at that number and address about what you asked for. We may call you, text you, send you voice notes, leave you voicemails (including voicemails left without the phone ringing), send you prerecorded messages and email you. These calls and messages may be placed or sent with automated technology, including systems that dial numbers automatically, and may use an artificial or AI-generated voice.
• Marketing only when you say yes. We send marketing calls and texts, such as offers of our app marketing services, only to people who agreed to them where we asked: for example by ticking a box, by saying yes in a chat to words that say so, or in an agreement they signed. A call or message that offers you anything to buy counts as marketing. Agreeing is never a condition of buying anything. Every marketing email has an unsubscribe link.
• AI assistants. AI assistants may write, send and answer our messages, and place and take our calls. These terms are our notice, given before any call or message, that you may be dealing with an AI assistant and not a person. A single call or message may not say so again, except where the law requires it. An AI assistant never denies being one: if you ask, it tells you, and if you ask for a person, someone from our team replies.
• Recording. Calls, chats, video calls and voice messages with us may be recorded, transcribed and analyzed by us, by our AI assistants and by the companies that run our phone, chat, transcription and AI systems. We do this to answer you, keep accurate records, train our team and our AI assistants, check quality and resolve disputes. By taking part, you agree to this, including where the law asks for the consent of everyone taking part. Calls also say at the start that they are recorded.
• Stopping. You can withdraw any of these consents at any time, in any reasonable way: reply STOP to a text, say so on a call, or email [email protected]. We act on it within 10 business days, and we may send one text to confirm it. Stopping marketing does not stop messages about something you asked for.
• When we call. We call and text at reasonable hours in your local time, within the hours the law allows. Every call and voice message says who it comes from.
• Your number stays with us. We never sell your number or your consent, and we never share them with anyone for their own marketing.

Disclaimers and liability

This website is provided "as is". To the fullest extent the law allows, we disclaim all warranties about it and are not liable for indirect or consequential losses from using it. Our total liability relating to it is limited to US$100. Nothing here limits liability that the law does not allow us to limit.

Governing law and disputes

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Before filing a claim, please contact us at [email protected] so we can try to resolve it; we will respond within 30 days. If we can't, either party may bring the claim in the state and federal courts located in Onondaga County, New York, and both parties consent to their jurisdiction. Either party may also bring an individual claim in small claims court where it qualifies.

If you are a consumer, you keep any rights the laws of the place you live give you that cannot be waived by contract, including the right to bring a claim in your local courts where those laws allow it.

Changes to these terms

We may update these terms. We change the date at the top, and for a material change we give you at least 14 days' notice by email or in the site before it takes effect. Changes don't apply to disputes that arose before they took effect.

General

• Entire agreement. These terms, together with the policies they link to, are the whole agreement about their subject. A signed written agreement governs where it conflicts with these terms.
• Assignment. You may not transfer these terms without our consent. We may transfer them to an affiliate or to a successor in a merger, acquisition or sale of assets.
• Events outside our control such as outages of networks or providers, natural disasters or government action excuse delays they cause.
• Severability and waiver. If a provision can't be enforced, the rest still applies. Not enforcing a provision is not a waiver of it.
• Notices. We send notices to the email address on your account or post them in the site. Send notices to us at [email protected] with a copy to Intentionally Creative LLC, 4465 E Genesee St., Syracuse, New York 13214, United States.
• Export laws. Don't use Homescreen where US export or sanctions laws forbid it.
